TIC and HOA Concerns

Utrecht & Lenvin represents owners in residential tenancy in common (TIC) disputes as well as condominium owners, and officers and directors of home owner associations and co-ops.  We provide real world advice about the pros and cons of litigating or arbitrating disputes against neighbors and third party contractors.  Concerns regarding future disclosure obligations on re-sale and the possible erosion of already strained neighbor and co-owner dynamics often militate against formal prosecution of legal disputes.  We often resolve disputes through informal mediation but engage in binding arbitration and litigation when necessary.  Whether our HOA or TIC clients require revisions to TIC agreements or CC&Rs or assistance with dispute resolution or the services of an outside general counsel, we offer practical and cost-effective solutions. We have imposed general and special assessments, foreclosed upon delinquent assessments, rescinded transactions based upon violation of Subdivision Map Act, litigated handicap accessibility and accommodation issues as well as common area maintenance disputes.
